California facility faces nursing home neglect charge

Most families struggle with the decision to turn over the care of a loved one to a total stranger, be it a nursing home, long-term care facility or other senior housing complex. For many, the hardest part is reconciling the level of care that person will receive with a certain dollar amount paid. Every family hopes that they have chosen the best facility for their family member that they can afford. Understandably, when a loved one passes amid claims of nursing home neglect, the surviving family members may elect to gain an understanding of their rights under California laws.

Nursing home neglect claims in senior care and assisted living facilities can include negligent care of bedridden residents that leads to bedsores, bodily injury and poor hygiene. One family in California recently experienced what they believe is a case of nursing home neglect. A suit was filed, alleging that a residential care facility was guilty of neglect and abuse. The facility is facing nursing home neglect, elder abuse and involuntary manslaughter charges.

The deceased woman had developed massive bedsores that led to sepsis. A doctor who was brought in to evaluate the case during the hearing stated that it would have taken days or weeks for such large bedsores to develop to that size. Also cited in the case are great bodily injury to the woman, among other complaints.

Families entrust skilled residential and assisted living care facilities with the care of their loved ones. Seniors deserve respect and proper medical attention. Care providers in California who fail in their responsibilities, or who commit neglect or abuse to those entrusted into their care, can be held accountable for their actions. Families who believe that they have lost a loved one due to nursing home neglect have the right to file a wrongful death claim against those responsible.
