Son files medical malpractice suit over mother's death

A woman outside the state of California died after allegedly being prescribed multiple medications that did not follow the manufacturer’s recommendations. Her son is pursuing a medical malpractice claim on her behalf both against the prescribing doctor as well as the pain clinic that he worked for. His suit is seeking compensation on both his and his mother’s behalf.

The woman first went to the pain clinic in March 2012, where she met with the doctor in question and reported issues with pain. After that initial visit, her son claims that she was prescribed 13 medications, including highly addictive painkillers like OxyContin. In total, she was prescribed over 900 pills from her various medications.

In the span of a year, the patient apparently met with her doctor at least once a month. During these visits, it is believed that her prescriptions were either rewritten or, in some instances, she may have also received new medications. In March 2013, she was supposedly taking eight different medications that had been prescribed to her. That same month, she suffered a cardiopulmonary failure.

Her son claims that the excessive amount of prescription medications that she was prescribed contributed to and ultimately caused her death. Both the doctor and the clinic that he practiced at have been named as defendants, as the son believes that the clinic acted negligently by not setting policies concerning the prescription of certain medications and also not supervising its employees. Though the amount the man is seeking is unspecified, he will likely be entitled to financial recourse for various expenses and mental anguish if his suit is successful. Families of California victims who may have been similarly over-prescribed medications may also file a medical malpractice suit on the deceased’s behalf.
