Family of alleged nursing home neglect victim files suit

Caring for loved ones in their old age can be a difficult but immensely important task for California families. When faced with having to place a grandparent in a nursing home facility, most families hope that they are making the best decision possible. Unfortunately, despite a family's best efforts at placing a loved one in a caring facility, nursing home neglect and abuse can still occur.

One California family may understand this better than many others. After fracturing her leg, an 85-year-old family member was taken to a local rehabilitation center. Shortly after arriving she reported to both the center's staff and her family that she had been sexually assaulted by one of the male employees. Although the claim was investigated, there has been significant confusion concerning the alleged perpetrator, and it's unclear whether he was arrested or if he is still employed at the rehab center.

Following the report, the family says that their loved one was put into a new room where she was kept isolated. At that point, she says that calls for assistance were routinely ignored, and she did not receive the care that she needed. The hospital countered that claim, instead insisting that she remained in her old room. It was her roommate, the hospital stated, that was moved out to provide the victim with more privacy.

Learning that a family member has been mistreated by those entrusted to care for them can be devastating. Families who have had loved ones suffer from nursing home neglect can understandably feel lost or confused about how to seek justice, especially when filing complaints may sometimes feel useless. Often, a wrongful death or personal injury claim can be an appropriate and effective course of action for victims, although it is quite common for family members to file on their behalf. Any awarded damages from a successfully navigated claim can be one of the first steps toward the most beneficial recovery possible.
