Woman claims nursing home neglect caused her mother's death

Those in a nursing home in California are often left without a voice. They are reliant on health care providers to ensure that their basic needs are met. Unfortunately, many fall victim to nursing home neglect. One out-of-state woman now claims that nursing home negligence caused her mother's death.

According to reports, the woman's mother had been a resident of the nursing home facility for approximately four years. During that time, she claims her mother fell eight times, often from her bed. Early one morning, she says that her mother was discovered, deceased, on her knees by her bed; her head was resting on her mattress with her chin toward the bed rail.

The woman claims that nursing home professionals informed her that her mother died from a heart attack that likely resulted from stress caused by a fall. However, she says that nursing home workers placed a towel around her mother's neck when she came to view the body; she alleges that this was done to prevent her from seeing her mother's neck. Despite the claims made by the nursing home, an autopsy reportedly revealed that the woman died as a result of positional asphyxiation -- that is, she suffocated as a result of the positioning of her head. Subsequent examinations reportedly support these claims.

As a result, the woman has filed a lawsuit, claiming that nursing home neglect caused her mother's death. Unfortunately, when family members make the decision to place their loved one in the care of such a facility, they place a great deal of trust in staff that appropriate care will be provided. As this case appears to indicate, failure to provide proper care can have serious consequences. Many in California who have lost a loved one in a similar manner have chosen a similar course of action, choosing to file a wrongful death lawsuit against the facility they feel is responsible for their loss.
